The process typically involves filing a written notice with the California Labor and Workforce Development Agency (LWDA) outlining the alleged violations at least 65 days before filing a lawsuit. The LWDA then has the option to investigate the claim or decline to do so. After the waiting period, the plaintiff can proceed with filing a lawsuit in court.
